In December 2017, we started to ask founders and others working in a startup to share with us, what interests them most. For those who are interested in patents, we prepared a brief questionnaire that should take only a minute to answer. If you did not yet do so, please take a look and submit your answer! Miriam runs a blog that will be a seed to grow, from 2019, a counselling business to help adolescents live their passion. The United States Provisional Patent Application

Many Europeans are not familiar or comfortable with a particular type of patent document known as a “provisional patent application” (or “PPA” for short). The PPA is a type of application that exists only in the United States and India. In his contribution, Larry M. Goldstein focuses on the US PPA. This will be the first of several contributions that explain the use of the provisional patent application in US patent law.

How can I protect my innovative idea against copycats?

How can I protect my innovative idea against copycats? – This may well be the first question to be asked upon conception of an idea. If that question is not answered to satisfaction, the innovation may later be stillborn.

Your innovative concept can only turn into successful business, if you are fast to implement your innovation. In order to be fast, you need support. Support requires sharing. Sharing requires trust. Still, you need a satisfactory answer to that first question: How can I protect my innovative idea against copycats?

In discussions, we hear that question a lot. The answer can be complex, since an innovative concept typically has multiple facets that require different means of protection. Ideally, all those people that the innovator needs to talk to should obligate themselves to secrecy. But how can that be achieved?

Our contribution discusses a non-disclosure agreement (NDA) as an instrument to initially protect the innovation. The contribution comprises a brief summary of elements that an NDA should have, free template terms for use in an NDA, and a few comments that should help understand why the template terms were included and drafted as shown.

A new tool for German speaking founders

Apparently, we at patanswer GmbH were not the only ones to believe that startup companies needed an improved access to information. The German Economic Affairs Ministry seems to have thought so as well! This month, the ministry launched a new Internet platform for founders. The platform not only offers information but also a tool for use in the development of a startup: brainstorming business ideas, planning a startup including even testing of a business model, and finding funding partners. We plan to test the platform and report in the months to come. Also, should you have used the platform, please share your experiences with us for publication on this site!

World Intellectual Property Day 2018

On April 26, the World Intellectual Property Organization (WIPO) commits the “World Intellectual Property Day”. This day is dedicated to learn about the role that intellectual property rights (patents, trademarks, industrial designs, copyright) play in encouraging innovation and creativity. According to WIPO, this year’s World Intellectual Property Day campaign celebrates the brilliance, ingenuity, curiosity and courage of the women who are driving change in our world and shaping our common future. WIPO goes beyond the waffle of the day though. First of all, WIPO presents captivating stories of women who make a difference by innovation. Further, WIPO provides an overview of IPR related events that will be held this year in various locations around the globe.
